Simpler Recycling: what happens if your business doesn't comply?

England's Simpler Recycling rules are no longer a future problem — they're already law for most businesses, and the deadline for the smallest firms is now under a year away. So it's worth knowing exactly what happens if your business doesn't comply, and how simple it is to stay on the right side.

Where the rules stand

• Since 31 March 2025, businesses with 10 or more employees must separate dry recycling (paper and card, plastic, metal, glass) and food waste from general waste.
• By 31 March 2027, the rules extend to micro-businesses with fewer than 10 employees — that's now roughly six months away.
• Food waste can no longer go in general waste or to landfill — it must be collected separately for treatment.

What happens if you don't comply

Enforcement sits with the Environment Agency. In practice it works in steps:

1. If your business isn't separating waste correctly, you can be issued a compliance notice telling you to put it right.
2. Failing to comply with that notice is an offence, and can lead to further enforcement action.

The approach is designed to help businesses get compliant rather than to catch them out — but ignoring it is not an option, and the reputational risk of being a non-compliant business matters too.
